As an online coach or service-based entrepreneur, you know how essential it is to protect your business from a legal standpoint. But there’s so much uncertainty when it comes to the legal aspects of running a business that many business owners don’t know where to start or what to do. It’s overwhelming, to say the least!
Because of this, it’s not uncommon for essential legal policies, documents, and agreements to take a backseat. But pushing these things to the side can be severely detrimental to the success and longevity of your business.
So, if you're missing key legal documents, or even worse, if you’ve haphazardly created your own legal policies on a whim (for instance, by copying and pasting PDFs you’ve found online—Yikes!), you’re going to want to read this post in its entirety.
The future of your business could depend on it.
Several years ago, I had the fortunate pleasure of meeting Bobby Klinck, a Harvard Law graduate who entered the world of entrepreneurship in 2010.
Bobby’s a great guy, and obviously very intelligent. But what stands out most about him is his innate ability to make sense of business law and all of its accompanying legal documents. He doesn’t use scare tactics to sell you on things you’ll never use, or speak in terms that only make sense to attorneys. He’s simply transparent and straight to the point while providing legal knowledge and expertise to help ensure online businesses like yours and mine are legally protected.
I recently interviewed Bobby, where he shared the Top 5 Policies To Legally Protect Your Coaching Business When Advertising.
These policies include:
I’ve broken down the key components of each policy below for quick reference, but I still recommend you check out the above interview for even more insight and understanding of these five legal policies. I suspect you’ll be pleasantly surprised by Bobby’s ability to make sense of legalities with his concise and engaging approach.
Privacy Policy
Are you thinking about running paid ads to capture more leads and increase sales? Then you better have a solid privacy policy in place!
A privacy policy is the one policy that every business owner needs, especially if you plan to run ads to generate consistent leads and sales. As a matter of fact, these days you cannot even get an ad approved to run on most (if not all) platforms without a privacy policy.
Keep in mind, that your local attorney will likely charge at least $200-$300/hr for a simple privacy policy… which is definitely on the cheaper end of the scale in terms of legal documents (especially when attorneys charge upwards of $4,000 to write up just one simple contract).
However, you can grab Bobby’s Free Privacy Policy Generator and create a customized privacy policy specific to your business in less than five minutes!
Over 20,000 entrepreneurs have created their privacy policy with this generator, and it’s the same one that Bobby uses himself, so you know it’s good.
Look, there’s nothing fun about legal policy. You know it, I know it, we all know it. At least with the Privacy Policy Generator that Bobby offers, you can skip the headache. It’s truly a painless and simple process.
Terms of Use
Chances are you’ve seen Terms of Use hyperlinked on the footer of most websites, but what does that really entail?
Bobby describes the Terms of Use as an opportunity to establish background rules for people who are accessing and engaging with your website.
It essentially says, “Here are the rules that apply to you, the user, as you interact with my website.”
Years ago, Terms of Use was a simple sentence. But now it’s an extensive, in-depth legal policy. Although it started as a one-sentence policy, over the years, attorneys have worked diligently to close all potential loopholes that did and/or could potentially pop up. So while you could create a Terms of Use that’s simple and straightforward, it’s best to leave it to the experts and keep all their legal jargon within the Terms of Use.
Disclaimer
There’s another legal policy that goes hand-in-hand with the Terms of Use. It’s a Disclaimer.
According to Bobby, the Disclaimer has two functions:
What I took away from Bobby’s explanation is this: The disclaimer puts the onus on the website viewer, as opposed to you, the website owner.
Coaching Agreement Contract
As a coach, you’re committed to helping your clients transform their lives in some capacity.
But what happens when you have a client who doesn’t put your guidance into practice and then turns around and blames you? Or when a client wants to cancel their coaching package prematurely?
At some point or another, you’re bound to come across a scenario that requires you to reference back to your coaching agreement. But if you found a generic business agreement online that doesn’t cover the foundational aspects of your coaching business (or worse, you never had your client sign an agreement), you could very well be out of luck.
But I get it! No one wants to focus on the legal mumbo-jumbo. You just want to help people!
Even so, a proper coaching agreement is VITAL.
One of the many aspects of Bobby's legal agreements that I find to be so valuable is a clause that he has within his agreements that essentially states that either party can opt to waive certain conditions within the agreement one time, without it having to be done again in the future. This allows for some flexibility within the agreement without it hindering either party.
Program Agreements
I hate to be the bearer of bad news, but we no longer live in a time where handshake agreements are all that you need to protect yourself and your business. That’s why it’s important to have all of your ducks in a row for all the “just in case” instances.
Your program agreement is an essential part of achieving this.
It covers things like…
If your new enrollees have a thorough understanding of agreed-upon terms in writing, you can avoid potential confusion and frustration. Not only does it set upfront expectations, but it really minimizes the potential for hurt feelings.
